We’re collectively in hysterics at the antics of the Fool Off the Hill (OK, it’s a little obscure, but it’s our new name for HER), whose reaction to the [1] just announced IATSE-AMPTP deal is the following astonishing nonsense: 

Talk about a conveniently timed announcement intended to undermine SAG’s federal mediator-ordered formal talks with the AMPTP tomorrow. It’s also conveniently timed to undercut the WGA’s news today that it’s going after Big Media for reneging on making those New Media payments contained in the new contract. But labor sources tell me they suspect this is a phoney baloney announcement because there’s not even any revelation of terms in the news release. 

Never mind that the “convenient timing” is because the negotiations have been going on this week and have just concluded. Apparently the Fool Off the Hill can’t read any better than she can report. This is the part of the press release she apparently couldn’t understand.

The IATSE-AMPTP agreement is consistent with the five other major agreements AMPTP has already negotiated this year, and it includes meaningful economic gains and groundbreaking new media rights. … Terms and conditions of the tentative agreement are in line with industry standards as established by other labor negotiations in 2008, and with applicable modifications for the particular needs of IATSE members. The IA received the unanimous support of the negotiating committee to recommend ratification of the tentative agreement by the membership. 

 Now maybe it would have been better to put percentages and a little more detail in the release, but it looks like the IATSE committee figured with the economy in crater mode, it’s better to have a deal with raises than not.

Update:  We’ve heard from a reader who says the Fool is censoring comments on her loony post, and refused to publish a sarcastic note saying that the IATSE contract is obviously all part of a worldwide conspiracy against SAG and Membership First, and that everyone is in on it, except for the Allens.

Maybe IATSE felt the members had a right to hear what the deal is, and vet it … before going public with the particulars.

Well, you know the “labor sources” that Nikki refers to are simply the same Membership First people that feed her all the rest of her content.

And you know that IATSE would willingly participate in a “phoney baloney” deal announcement for no other purpose than to disadvantage SAG.

It may be important to note that the AMPTP/IATSE deal, purportedly, includes “…applicabale modifications for the particular needs of IATSE members”.

Thankfully, the AMPTP admits to the fact that different unions, and their various members, have “particular needs.” Perhaps this is an indication that, unpredictable, Nick might be moved to do what’s right, after all? Will the AMPTP back off of it’s Draconian contract rollbacks? Dare we hope Nick and the AMPTP has seen the light? For the good of all, please, AMPTP, authorize Nick to cut a fair deal that continues to meet the “particular needs” of S.A.G. members, too.

SOMEBODY PLEASE NOW LIST ALL OF THE AMPTP “DRACONIAN CONTRACT ROLLBACKS” IN THIS DEAL. Okay, okay - besides force majeure. LIST THEM.

This is the kind of exaggeration that gets us nowhere Renee.

It’s why members don’t believe Membership First anymore.

In case you have forgotten what’s in the contract, I hear Ginko Biloba helps. Here are some key rollbacks proposed by the AMPTP:

Clip Consent (loss of longtime protections re voice, image and likeness)
Product Placement (Commercial Endorsements for no pay, products part of scene)
NON-UNION under $15,000/Minute (Principals never before Non-union under S.A.G.)
Force Majeure (you remembered this one)
UNLIMITED USE of PRE-1974 TV Classic Series NO RESIDUALS in re Now Media

Yeah - that’s what I thought.

Clip Consent - this one’s been gone a long time ago. There are clips of actors playing all over the internet, with no “consent” whatsoever. Minor sticking point. Hardly “draconian”.

Product Placement - hardly a “rollback”. This has been going on since I began in this business in the Sixties. I remember saying “Chevy” a dozen times in a film in the early Seventies.This is an issue best handled by the Commercials contract.

NON-UNION under $15,000/Minute - is not a “rollback”. All internet issues are new. Non-union actors have worked side-by-side with SAG actors for years under many of our agreements.

Force Majeure - Yeah, this one I know. Have YOU ever had to deal with Force Majeure in your entire career? My experience is that those actors with clout negotiate their own force majeure productions. I challenge anyone on this board to come forward with an anecdote about how Force Majeure helped them at any given time.

UNLIMITED USE of PRE-1974 TV Classic Series NO RESIDUALS in re Now Media - Once again, NOT a “rollback”. All New Media (cut the “Now Media” crap, why doncha?) must be negotiated fresh. Just for Kent and Davey, I suppose…..

You see, folks? There are no “DRACONIAN ROLLBACKS” at issue here. MFers who’re just aching for Their Strike will throw all kinds of crap like this up against the wall. None of it sticks.

Ginko Biloba? Try a dollop of reality, Renee.

Draconian rollbacks is the correct term. Either YOU are completely, forgetful and/or out of touch with reality or you do not care a rat’s ass about doing what is FAIR and right for S.A.G. members. You’d give away the FUTURE without a second thought. Obviously, your memory is impaired. Try Ginko.

Yes, Reality is Reality (and it’s scripted on TV). Clearly, S.A.G. is at a crossroads. Hopefully, we are NOT at cross-purposes.

Right. When you cannot successfully argue, start rolling out the Arlin Miller/Membership First stock-in-trade disparagement. Sorry for the typo. However, my information is correct. Obviously, you must spend more time typing than I do typing on these BB’s. No one is better than you when it comes to insults. You win! I refuse to compete with you when it comes to disparaging remarks. You have been thrown off at least two other BB’s just for that reason. You are KING when it comes to spreading gossip, misinformation, and smear.

If SAG gets improvements over AFTRA’s Prime-Time TV (Exhibit A) Contract, it will only make SAG’s contracts more expensive than AFTRA’s. This is because there are no Favored Nation clauses in the AFTRA Prime-Time TV (Exhibit A) Contract. SAG Actors were checkmated by the AMPTP. The penny pinching bean counters at the conglomerates would go with AFTRA over 50 per mile( if SAG could get it) vs. 30 per mile (which AFTRA got).

The only area were SAG could garner improvements and not shoot itself in the foot are in the area of Motion Pictures.

From what I’ve read the most Draconian cutbacks were inflicted on SAG’s New Yorks Background Actors 10 years ago. This was caused by circumstances beyond their control, the colapse of another union called SEG, which covered extras in Hollywood.

SAG used to have total effective coverage over the Extras at 125 per Motion Picture in New York. Since Motion Pictures is an area that AFTRA and SAG do not share jurisdiction, perhaps SAG could garner some face saving improvements, by increasing Background Actor numbers just for *Motion Pictures* in New York and Hollywood.

This would not break the so called “pattern” and the little guy (extras) deserve it, because they have suffered the most Draconian cutbacks.

It was never insults that got me tossed from any bulletin board, honey -
It was my posts that helped get our last TV/Theatrical contract ratified that pissed Hamilton off. Poor thing.
You obviously have never read the posts of Neil Guintoli or Arlin Miller or Terrence Beasor
or you wouldn’t call me the King of gossip, misinformation, and smear.
I couldn’t hold a Disparagement Candle to those three.

And when the Membership First leaders of SAG’s Negotiating Team
get their act together and make a deal
they’ll get support of the vast majority of the membership, including me.

Considering the Big Picture, Mike, I think you have the right idea.
SAG should, in my opinion, dedicate the entire new money of one contract cycle
to improving the rates & numbers of background performers.
The previous draconian cutbacks in New York were gleefully performed by Hollywood.

The present contract cycle has already been blown.
Leave the majority of New Media to the next cycle.
Hold onto force majeure now, and close the deal.
That’s what we’ve been locked into.
You can strike til the cows come home, but that’s what you’ll get.

The most entertaining part of Finke’s recent posts on these subjects has been her swallowing the the most extreme point of views on both the WGA dispute and the impasse in the SAG/AMPTP talks. It’s more than ironic to see her referring to the other party’s behavior as “shameful.” This from a person who gleefully printed the text of a Christmas card sent from a producer to a TV show crew during the WGA strike and then added the bonus putdown “I’m told there was no money in the envelope.” I continue to be amazed that this person has any credibility left in this town.
